Privacy Policy

This Privacy Policy explains how Best Drivers may collect and process personal information for online services accessed from mobile and desktop devices. Please note that this is a general overview of what may be processed and additional specific notices and terms will be applied within specific Mobile Apps where appropriate and/or required by law.

This policy describes how Best Drivers and its affiliates collect and use personal information to provide our services. This policy applies to all users of our apps, websites, features or other services anywhere in the world. This policy specifically applies to:

  • Passengers: users or companies who request or receive transportation from Best Drivers
  • Drivers: users who provide transportation for Best Drivers
  • Best Drivers users: users that provide trasnsportation services to passengers

This policy also applies to those who provide information to Best Drivers in connection with an application to use our services, or whose information Best Drivers otherwise receives in connection with its services. All those subject to this policy are referred to as “users” for purposes of this policy.

Unique Device Identifiers
A unique device identifier (or “Unique Device ID”) is an alpha-numeric string of data that can either be part of the hardware of your device or automatically assigned to your device by the operating system or software. This identifier is used to ensure that an user does not run the app in different devices.
Location information
Depending on the user type, their app settings or device permissions, we may collect their precise or approximate location information as determined through data such as GPS, IP address and WiFi.
  • Drivers: we collect location information when the Driver app is running in the foreground (app open and on-screen) and background (app open but not on screen) of their device. Collection of location information is required for drivers
  • Passengers: We may collect location information when the Passenger App is running in the foreground. Passengers are not required to turn on location services to use the Passengers app. However, opting out may affect the app’s functionality. For example, users will have to manually enter their pickup address. Location information for every trip is collected from the driver, even if location information is not being collected from the passenger’s device.
Log Information
When you use the Mobile App or view content on our websites on a mobile device, we may automatically collect and store certain information in server logs including but not limited to internet protocol (IP) addresses, port numbers, device model and make information, internet service provider (ISP), clickstream data, battery and memory allocation, boot time, browser type and language, viewed and exit pages and date or time stamps We may use log information as specifically indicated in the Mobile App, as well as to assess the performance of our Mobile App or other online services, distinguish your device from others, prevent fraud, provide technical support and/or respond to your needs. We may also use this information to personalize the services offered by us or our affiliates, including providing personalized advertising on some Mobile Apps.
Unique Mobile App numbers
When you install or uninstall a Mobile App containing a unique Mobile App number, or when such a service searches for automatic updates, that number may be sent to us. Information about your installation, for example, the type of operating system, may also be sent to us. We may use the Unique Mobile App numbers as specifically indicated in the Mobile App, as well as to assess the performance of our Mobile App or other online services, prevent fraud, provide technical support, conduct research, generate analytics, address internal online services operations, and/or respond to your needs. We may also use this information to personalize the services offered by us or our affiliates, including providing personalized advertising on some Mobile Apps.
User Profile
We collect users’ names, logins, passwords, and phone numbers and/or email. For drivers, passengers and companies requesting transportation services, we also collect name, email, phone number, address, payment or banking preferences, government identification numbers, birth date and signature. This also includes vehicle and insurance information of drivers. This also includes the preferences and settings passengers enable for their App.

Some of our products, services and features require that we share information with other users on request. We may also share user information with our affiliates, subsidiaries and business partners, for legal reasons or in connection with claims or disputes.

We may share the information we collect:

  • With other users
    • For example, when a passenger uses our service, we may share their name, pickup and/or drop off locations with drivers. If users share a trip with another user, that user may be told their name and may see their pickup and/or drop off location.
    • When a driver uses our services, we may share information with their passengers including name and photo; vehicle make, model, colour, license plate, and vehicle photo; location; average rating provided by passengers; and the ability to contact the driver via text/call.
  • With our service providers and business partners. We may provide information to our vendors, consultants, marketing partners, research firms, and other service providers or business partners. This may include, for example:
    • Payment preferences.
    • Data analytics providers.
    • Vendors that assist us to enhance the safety and security of our apps.
    • Consultants, lawyers, accountants and other professional service providers.
  • For legal reasons or in the event of a dispute
    • We may share a user’s information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.
    • This includes sharing our information with law enforcement officials, government authorities, airports (if required by the airport authorities as a condition of operating on airport property), or other third parties as necessary to enforce our Terms of Service, user agreements, or other policies, to protect our rights or property or the rights, safety or property of others, or in the event of a claim or dispute relating to their use of our services. If they use another person’s credit card, we may be required by law to share information with that credit card holder, including their journey information.
    • This also includes sharing user information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

We retain user profile and other information for as long as required by users and transportation services companies.

Users may request deletion of their accounts at any time by writing to privacy@karbooking.com. Following such request, we delete the information that it is not required to retain, and restrict access to or use of any information it is required to retain.

We require user profile information in order to provide our services, and retain such information for as long users maintain their account.

This section summarises our grounds for processing personal information under the GDPR, and the rights of EU users as relates to our handling of personal information.

Beginning May 25, 2018, the processing of personal data of users in the European Union is subject to the EU General Data Protection Regulation (“GDPR”). This section provides information as relates to EU users’ rights, and our responsibilities, under this regulation.

Our users in the EU have the following rights with respect to our handling of their personal information. To exercise these rights, please see below or submit a request to privacy@karbooking.com.

Users outside the EU may also request explanation, correction, deletion or copies of their personal data to privacy@karbooking.com.

a. Explanation and copies of user data

  • Users have the right to request an explanation of the information that we have about them and how we use that information.
  • Users also have the right to receive a copy of the information that we collect about them if collected on the basis of consent or because we require the information to provide the services that users request.

b. Correction

  • If we have information about users believed inaccurate, users have the right to request correction of that information. Please see the section titled “Explanation, Copies and Correction” below for more information on correcting, or requesting correction of, user information.

c. Deletion

  • Users may request deletion of their accounts at any time. Users may request deletion by writing to us to privacy@karbooking.com. We may retain certain information about users as required by law and for legitimate business purposes permitted by law.
  • Please see the “Information Retention & Deletion” section above for more information regarding our retention and deletion practices.

d. Objections and complaints

  • Users in the EU have the right to object to our processing of personal data, including for marketing purposes based on profiling and/or automated decision making.
  • Users in the EU also have the right to file a complaint relating to our handling of their personal information with the Information Commissioner’s Office. Their contact information is as follows:

The GDPR requires that companies processing the personal data of EU users do so on the basis of specific legal grounds. As described below, we process the information of EU users based on one or more of the grounds specified under the GDPR:

The processing is necessary to provide the services and features users request

  • We must collect and use certain information in order to provide our services. This includes:
  • User profile information that is necessary to establish and maintain a user’s account, including to verify their identity; enable communications with them about their trips, orders and accounts; and to enable passengers to make payments and drivers to receive payments.
  • Driver location information, which is necessary to match drivers with passengers, to guide the driver to the passenger’s pick-up location and to track trips while in-progress and suggest navigation.
  • Transaction information, which is necessary to generate and maintain in connection with users’ use of our services.
  • Usage information, which is necessary to maintain, optimise and enhance our services, including to determine, sometimes in combination with other information, estimated time of arrival, best route and fares.
  • Collection and use of this information is a requirement for using our apps.

The processing is necessary to protect the vital interests of our users or of others

  • We may process personal information, including disclosing data with law enforcement authorities in case of threats to the safety of users or of others.

The processing is necessary for our legitimate interests We collect and use personal information to the extent necessary for our legitimate interests. This includes collecting and using information:

  • To provide customer support.
  • To optimise our service and develop new services. This includes, for example, identifying the best pick-up / drop locations, recommending (new) features, improving navigation and matching passengers and drivers.
  • For research and analytical purposes. This includes, for example, analysing usage trends to improve the user experience and enhance the safety and security of our services.
  • For direct marketing purposes. This includes, for example, analysing data to identify trends and tailor marketing messages to our customers’ needs.
  • To enforce our Terms of Service.

The processing is necessary to fulfil our legal obligations

  • We are subject to legal requirements in the jurisdictions in which we operate that require us to collect, process, disclose and retain user personal data. For example, We are subject to laws and regulations in many cities and countries that require it to collect and retain information about passenger trips, to retain such information for extended periods of time, and to provide copies of such information to governmental or other authorities. We use user information to comply with such laws to the extent they apply to their use of our apps.
  • We may also share information with law enforcement, or requests by third parties pursuant to legal processes.

Consent

  • We may collect and use user information on the basis of user consent. Users may revoke their consent at any time. If a user revokes consent, they will not be able to use any service or feature that requires collection or use of the information we collected or used on the basis of consent.
  • We rely on consent in connection with data collections or uses that are necessary to enhance the user experience, to enable optional services or features, or to communicate with users. For EU-based users, the following types of data collections or uses are done on the basis of user consent.

We provide means for users to request to see, or request to delete the information that we collect. Users may also request that we provide them with explanation, copies or correction of their data.

Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without user consent. And these platforms have different permission systems for obtaining user consent. The iOS platform will alert users the first time the app wants permission to access certain types of data and will let users consent (or not consent) to that request. Android devices will notify users of the permissions that the app seeks before users first use the app, and a user’s use of the app constitutes their consent.

Users may request that we:

  • Provide them with a detailed explanation regarding the information we have collected about them and how we use that information.
  • Receive a copy of the information collected about them.
  • Request correction of any inaccurate information that we have about them.

Users can also edit the name, phone number and email address associated with their account through the User Configuration menu. Users can also look up their previous bookings through the Services menu.

We may occasionally update this policy. If we make significant changes, we will notify users of the changes through the apps or through others means, such as email. To the extent permitted under applicable law, by using our services after such notice, users consent to our updates to this policy.

We encourage users to periodically review this policy for the latest information on our privacy practices. We will also make prior versions of our privacy policies available for review.
